Disability is emotionally draining and causes many people to become angry and complacent. Keep a positive attitude daily. I found that the following things help me. Try making a list of daily task. Keep important things at the top of your list. Work through your list daily at your own pace. Never panic if things don't get done just start working on them tomorrow. Always keep a folder with your information in it. Friends and family are your best source for help. Always ask more than one person to help you and avoid stressing any one person out. Do things on your own when ever possible. The longer you wait the harder it is to get things done.
Occasionally a case worker has been known to be helpful when they believe in your claim. Case workers often use scare tact's, such as not paying you or your doctor's until you have returned to work. When you're disabled all this does is hurt you financially and emotionally. A better system needs to be put into place to ensure that disabled people are care for by their employers and not abused.
After receiving your medical reports from an independent medical examiner make sure you fax the reports to your case worker after having them signed in front of you by the person who handles workers compensation cases at your work place to ensure you receive a pay check.
Employers have been known to tell their employees that they would sign these medical papers and the papers become lost or misplaced. Having your papers signed right in front of you eliminates this problem. The amount you get paid also depends on the degree of disability established by the independent medical examiner.
Worker's compensation allows you to have private medical coverage and still collect benefits, this includes medicade and medicare. But you must qualify for these programs. The problem is that most people who are disabled during their first year have already earned too much money from when they were working to qualify for medicade or medicare. This problem leaves most people without medical care.
Workers compensation requires you to have certified worker's compensation doctors. Workers compensation doctors can only prescribe medications related to your claim. These medications should never be paid for by a person on workers compensation. However you must find medical doctors that are workers compensation qualified in order to receive prescribed medications from them. It is illegal for a pharmacy to take money for medication issued from a workers compensation doctor.
Receiving unemployment while on worker's compensation is possible but if you do receive unemployment you risk the chance of being accused of trying to find work and could lose the job that you already have. I believe you should avoid unemployment.
Workers compensation sometimes list doctors who no longer work with them or are full with patients and can not except you. Doctors often don't except workers compensation cases because it takes to long to get paid and there is too much paper work.
When appearing in court the less you say the better it helps your lawyer who is trying to present your case to the judge and saves everyone time.
It might seem like the company lawyer is attacking you but remember they're only doing their job. The best way to find a good lawyer is by word of mouth. Ask around the work place to see if your co-workers know of any good worker's compensation lawyers this is the best way to find one.
The workers compensation system needs to change the way it treats people with mental disorders that are caused by accidents on the job. Workers compensation puts unnecessary stress on these clients by asking them to find doctors who are qualify and certified by workers compensation. This policy needs to be changed so that they offer certified doctors to their clients. Mental illness is a serious disorder and can cause the mind to not function well. Workers compensation demands that a client with mental disorders concentrate to long looking for doctors that should already be available to them. This is an unfair practice and is torture to many people.
Mental health doctors do not advertise and this makes it nearly impossible to find a certified doctor. Disabled workers feel angry discourage resentment disappointed and rejection by the system. Many feel let down and discarded. Don't give up ask your family and friends for help. Take a deep breathe and try again you can do this. Many times there are few if any doctors in your area check the surrounding areas within a 50 miles radius.
