Same-Sex Marriage in Canada

If two people are in love, nothing or no one should keep them from being bound together by marriage.

Every couple has the right to enjoy of being in love. If marriage is the only thing that could fully nourish the couple's love, regardless of gender, let them savor the glory of their love. If two people of the same sex want to marry, it would be another story. There would be many arguments about this. For instance the sanctity of marriage becomes less valued. Throughout the history, more than just a commitment or a duty, marriage is a religious ceremony of the unity of a man and a woman to establish a family. The family, consisting of a father and a mother then is the building block of a community.

Same-sex marriage is a term for a governmentally, socially, or religiously recognized marriage in which two people of the same sex live together as a family. Marriages or relationships involving two people of the same sex had been condemned in the society. Until in 2001, the government of Netherlands first made an attempt to allow same-sex marriage. In later years, other countries such as Belgium, Spain, Canada and South Africa began to recognize it also.2 Same-sex marriage has become a phenomenon then. Upon granting the rules of same-sex marriage in Canada, same-sex couples have received the same benefits and obligations as the opposite-sex couples. However, no matter what the rule would say about its legalities, it has still remained as a controversial issue. There is always a complicated discussion about the same-sex marriage. Still, same-sex marriage has been successfully recognized legally in other countries.

Historical and anthropological evidence around the globe shows that same-sex couples have formed intimate long-term relationships. While the nature of marriage has changed over the millennia, one thing that has not changed is that same-sex couples rarely have the same acceptance as of the opposite-sex couples. In the early time, some same-sex couples have enjoyed social and even formal recognition of their relationships. However, most of them got so many criticisms about immorality issues. This is not supposed to happen because no matter what the gender whether a lesbian, gay, bisexual, transgender and transsexual should have the right of a full human dignity including marriage. Basically, everyone, regardless of gender has the right to get married and entitled to enjoy it. Although churches known to have opposed this kind of marriage, records of same-sex relationships in the history indicate that the concept and practice of same-sex marriage has never been entirely suppressed.

With the existence of same-sex relationships everywhere, there is a great demand of passing a law concerning same-sex marriage. It was not that easy in at the start. Before it was made legal in Canada, majority of the House of Commons of the Canadian parliament voted a resolution stating that “marriage is and should remain the union of one man and a woman to the exclusion of all others.” In the following years, there were consistent rallies, which made a great noise over the mass communication in whole the country asking for gender-fair laws. So, in latter years, the Canadian Supreme Courts landed on a decision of legalizing same-sex marriage. Consequently, same-sex couples were recognized for the purpose of, for example, health services, public- funded pensions, public-sector employment benefits, artificial insemination, child support, and custody for the non-biological partner. Then all through the years same-sex couples have finally received the same attention as the heterosexual couples in the legal matters.

The primary reason in denying same-sex marriage is that it is considered as an attack on heterosexual marriage, which is known historically as the best institution to raise children. Over the years, this controversy of same-sex marriage never stopped existing. Other issues also include the religious issues, social and traditional issues, having children issues, equality issues, economic and etiquette considerations. The above considerations are considered as far more important than the controversies over its recognition. The problem it may have caused could have even resulted an emotional dilemma or inferiority over the relationship for both couples. While there are few instances of societies recognizing same-sex unions as "marriage", there is also a notable variety of treatment of same-sex unions ranging from sympathetic toleration to indifference to prohibition. 

On the religious side of the controversy, they claim that same-sex couples destabilize the conventional purpose of marriage. Furthermore, Catholic Churches argue that same-sex marriage cannot fulfill common procreational roles. Such partnership is considerably centered only on sexual acts, which defies the purpose of marriage in the prospective of religion. For many of the members of the congregation, mere sex is about physical bodies while, "married sex" is godly and disembodied the soul. The traditional purpose of marriage is for creating children who can do best for the society. For them the acts of sexual intimacy are only proper between a man and a woman. Homosexuality is said to be against biblical teachings. Thus, any sexual involvement between both men and both women is definitely not morally acceptable.
