Judges are a select few of the Elite in our society who are not voted in by the people, like our supposedly democratic Government. Being part of this Elite sector means that they live in a completely different life to us Common Folk, one might say. One could suggest that they are out of touch, living high above in the clouds of "secret soundings" dinners and lunches. One might wonder why such a narrow cross-section of society is granted, as a group, supreme power, most notably of which is the House of Lords
On the other hand, judges are, however much they may not like it,part of the same country as us Common Folk. They do live here, so they must, therefore, have an understanding of the standards and customs of the present-- one would hope. Judges are in fact qualified in Law, and have a vast knowledge of it as the vast majority of judges have been in the business a very long time - especially the Law Lords!
From the Literal prospective, judges do make the law, through judicial precedent. But from the Purposeful prospective it is the Acts of Parliament that make law. This conflict of Sovereignty and Democracy, Literal and Purposeful, is not meant to last. The Literal and the Purposeful should be given to a body of true Democracy, this is the dreams of dreamers. To dream of a place like this to exist in today's world is simply that; a dream, and then it is gone, washed away into the night to bring upon the return to reality in the daylight. Why should anyone be afraid of the dark? We are. Therefore, the separation of powers is necessary, to make us feel safe when we should have no reason to feel scared in the first place.
All of you who are afraid of the darkness. All of you who do nothing to make a stand for your Liberty, for your Democracy, for your Freedom. All of you who sit and watch when you should get up and talk. All of you with the power to change but do not. I pronounce you all Nyctophobic. You, who fear the night.
